*Felicia's HoMe RESTAURANT reserves the right to cancel the Guest's reservation at any time without any obligation other than the refund of the sum paid.

The website www. https://www.feliciashomerestaurant.com (hereinafter “Website” or “Site”) is owned by Felicia's Home Restaurant DI FLAUTO FELICIA with headquarters in Via di Salvio 72 – Tramonti – 84010 – Salerno - VAT number: 06149120658 Italy and is managed by the same company.

The Home Restaurant activity carried out is an atypical activity, belonging to the so-called "sharing economy", which is carried out in the private home of Mrs. Felicia Flauto and aims to enhance and encourage the culture of traditional and quality food.

Users can browse the Website and make reservations by scrupulously adhering to these conditions.

1. PREMISES

The use of the Website https://www.feliciashomerestaurant.com by Users is governed by the conditions of use of the site which users accept by checking the appropriate boxes.

The booking service is aimed only at adult users capable of acting.

Given the atypical nature of the service offered, the structure in which it takes place (private residence) and the home preparation of food, it is not possible to manage specific needs, therefore menus and cooking experiences are not offered in case of food allergies or intolerances.

The experience is completely private, for this reason availability may be limited.
The menus offered may undergo variations based on the seasonality of the vegetables and products selected for the dishes prepared and offered to guests.

Each menu contains lactose and gluten.

Access to the private home where Felicia's home restaurant activities take place is guaranteed only to customers who have booked and paid for the experience. No additional guests will be allowed.

The premises constitute an integral and substantial part of this agreement.

2. USER OBLIGATIONS

The User must use the booking service by scrupulously complying with these Conditions.

It is the User's responsibility to read these conditions and check any changes made to them.

When providing the data necessary to proceed with the booking, the user has the obligation and responsibility to provide truthful, correct, verifiable and updated personal data. The personal data provided by the User through these forms will be processed by the Manager in compliance with the legislation on privacy, for the purposes and according to the methods described in the information provided by the Manager itself.

The User declares and guarantees that he has acquired all the necessary authorizations regarding the data of third parties possibly conferred to the Manager through the forms on the Site or through any other channel.

It will be the user's responsibility to check for any allergens or foods that trigger intolerances by contacting Felicia'home restaurant in Flauto Felicia before making the reservation.

You must inform other people for whom you make the reservation who have food allergies or intolerances that no menus are offered for these needs.

It is the responsibility of the user who intends to book, therefore, to ensure that none of the subjects for whom he is making the reservation are affected by food allergies or intolerances, or to inform them of the absence of specific menus before making the reservation.

The user must inform the Manager of the presence of minors at the time of making the booking.

To make a reservation, the user must select a specific date or period of time from those available in the Manager's calendar.

The user is obliged to pay for the entire service at the time of booking.

The user expressly accepts that, if weather conditions do not allow the experience to be held in outdoor spaces, the experience will be held in the interior spaces of the house.

3. COST OF SERVICE AND PAYMENT

The costs of the service are indicated on the site and are visible at the time of booking.

Advance payment of the entire service is required.

Payment is non-refundable.

Only the payment methods indicated on the screen are accepted.

The purchase currency in which orders are placed is indicated only at checkout, before payment.

4. CONCLUSION OF THE CONTRACT

The booking is confirmed when the Manager receives the payment.

It is not possible to cancel the reservation.

5. CANCELLATION OF THE RESERVATION AND EXCLUSION OF WITHDRAWAL

In the event of cancellation of the booking by users or their inability to attend the booked experiences, no refund or other compensation of any kind will be provided. However, if the user cancels the reservation at least 24 hours in advance, in case of calendar availability, the right to reschedule is granted within the limits of the following article.

The notice of cancellation must be sent exclusively by email, sending the communication to the address feliciashomerestaurant@gmail.com at least 24 hours before the start time of the booked event.

It is not possible to exercise the right of withdrawal as these are services relating to catering and leisure provided on a set date or period of time.

At any time the Manager may cancel the booking by refunding the entire amount paid by the user, without the User having to claim anything else for any reason or title.

Any refunds will be made by the manager on the same payment instrument used by the user to book, for the same amount and in the same currency used for the payment, nothing will be due for the difference in currency exchange rates that occurred in the period between payment and refund.

6. REPLANNING

Without prejudice to the above, if there is availability on the calendar, the Manager grants the User the possibility of rescheduling the event previously chosen and paid for on the NEXT calendar DAY for the same number of people booked and for the same economic value of the experience. chosen and previously paid.

7. FORTUNE EVENTS AND FORCE MAJEURE

In any case, the Manager will not be liable towards the user for unforeseeable circumstances, force majeure and/or for delays or failure to carry out its tasks due directly or indirectly to circumstances beyond its control. Force Majeure constitutes, by way of example and not exhaustively, the occurrence of (i) war (declared or not), hostility, invasion, acts of a foreign enemy, extensive military mobilization;
(ii) civil war, riot, rebellion, revolution, military force or usurpation of power, insurrection, acts of terrorism, sabotage or computer hacking including hacker attacks or Denial of Service aimed at damaging the service, subject to reporting to the competent authority ;
(iii) currency or trade restrictions, embargoes, sanctions;
(iv) acts of authority, legitimate or illegitimate, compliance with laws or government orders, regulations, expropriation, confiscation of assets, requisition, nationalization;
(v) plague, epidemic, natural disasters or extreme natural events;
(vi) explosion, fire, destruction of equipment, prolonged suspension of transportation, telecommunications or power;
(vii) generalized social conflicts, such as in particular boycotts, strikes and lockouts, white strikes, occupation of factories and buildings.

8. PRIVACY

9. AMENDMENTS AND FINAL CLAUSES

Should one of the clauses of these conditions be declared null or ineffective by the competent authority, the conditions will continue to have full effect for the part not affected by said clause, unless it constituted an essential and decisive reason for the conclusion of the relationships.

The fact that one of the parties does not assert at any time the rights recognized by one or more clauses of these conditions cannot be understood as a waiver of such rights nor will it prevent them from subsequently demanding compliance with any and all contractual clauses.

11. APPLICABLE LAW AND CONSUMER JURISDICTION

These conditions are governed by Italian law.

In case of translation, the Italian version prevails for interpretation.

For any dispute concerning the interpretation, validity or execution of these conditions to which a consumer is a party and which may fall within the scope of application of the Consumer Code, the competent court is that of the place of residence or elective domicile of the consumer. This forum is mandatory pursuant to art. 33, paragraph 2, letter u) of the Consumer Code.
